These Terms of Service ("Terms") govern your access to and use of the OperateEDU platform ("Service") operated by OperateEDU ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, purchasing a subscription, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are using the Service on behalf of a school, district, or organization, you represent that you have the authority to bind that entity to these Terms. In such cases, "you" refers to both you individually and the entity you represent.

If you do not agree to these Terms, you must not use the Service.

2. Description of Service

OperateEDU is a cloud-based school operations management platform for K-12 schools. The Service includes:

  • Workflow management and automation across operational domains
  • Task management, calendar, notes, and staff directory tools
  • Dashboards and reporting for school operations data
  • Operational assessments and resource library
  • Administrative tools for user management, roles, and school settings
  • Data import capabilities for student and staff records
  • Notification and communication features

The specific features available to your school depend on your subscription plan. Feature availability may change as we develop and improve the platform.

3. Account Responsibilities

When you create an account on OperateEDU, you agree to:

  • Provide accurate information. All registration and account information must be truthful, accurate, and complete.
  • Maintain account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@operateedu.com if you suspect unauthorized access.
  • Manage your users. The school administrator is responsible for managing user accounts, assigning appropriate roles and permissions, and deactivating users who should no longer have access.
  • Protect data appropriately. You are responsible for ensuring that users in your organization access only the data they are authorized to view, consistent with your school's policies and applicable laws (including FERPA).

We reserve the right to suspend or terminate accounts that violate these Terms or that show signs of unauthorized access.

4. Acceptable Use Policy

You agree to use OperateEDU only for its intended purpose: managing school operations for K-12 educational institutions. You must not:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or systems connected to the Service
  • Upload or transmit viruses, malware, or any code designed to interfere with the Service
  • Use automated tools (bots, scrapers) to access the Service without our written permission
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Share login credentials across multiple individuals — each user must have their own account
  • Use the Service to store or transmit content that is defamatory, obscene, or otherwise objectionable
  • Resell, sublicense, or redistribute access to the Service without our written consent

Violation of this policy may result in immediate account suspension or termination.

5. Subscription Terms

Plans and Billing

OperateEDU is offered on a subscription basis. Subscription details, including pricing and included features, are listed on our Pricing page. All prices are in U.S. dollars.

Free Trial

New schools may be eligible for a free 7-day trial. During the trial period, you have full access to the features included in your selected plan. No payment information is required to start a trial. At the end of the trial, you must select a paid plan to continue using the Service.

Billing Cycle

Subscriptions are billed either monthly or annually, depending on the plan selected. Billing begins at the end of your trial period (if applicable) or at the time of purchase.

Auto-Renewal

All subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date. You will be charged the then-current rate for your plan at each renewal.

Cancellation

You may cancel your subscription at any time through your account settings or by contacting support@operateedu.com. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until the end of the paid period.

6. Refund Policy

  • Monthly plans: If you cancel a monthly subscription, you will receive a pro-rated refund for the unused portion of the current billing period.
  • Annual plans: Annual subscriptions are eligible for a full refund if cancelled within 30 days of purchase or renewal. After 30 days, annual plans are non-refundable. You will retain access through the end of the paid year.
  • Billing disputes: If you believe you have been billed in error, contact support@operateedu.com within 60 days of the charge. We will review and resolve billing disputes promptly.

7. Data Ownership

Your data belongs to you. Specifically:

  • School data: All data you import into or create within OperateEDU — including student records, staff records, workflows, notes, reports, and any other content — remains the property of your school. We claim no ownership rights over your data.
  • Export: You may export your data at any time via the CSV export features available throughout the platform (reports, audit logs, dashboards, staff directory).
  • Deletion: Upon account termination, your data will be retained for 90 days to allow for export, then permanently deleted. You may request earlier deletion by contacting privacy@operateedu.com.
  • No data hostage: We will never restrict your ability to export your own data as a condition of cancellation or for any other reason.
  • License to operate: By uploading data to OperateEDU, you grant us a limited, non-exclusive license to use that data solely for the purpose of providing the Service to you. This license terminates when your data is deleted.

8. Service Availability

We strive to maintain high availability of the OperateEDU platform. However:

  • The Service is provided on a best-effort uptime basis. We do not guarantee 100% availability.
  • We may perform scheduled maintenance that temporarily affects availability. When possible, we will provide advance notice of planned maintenance.
  • We are not liable for service interruptions caused by circumstances beyond our reasonable control, including but not limited to: internet outages, third-party service failures (hosting providers, CDN, payment processors), natural disasters, or acts of government.
  • If the Service experiences a material outage affecting your school for more than 72 consecutive hours, you may request a pro-rated service credit by contacting support@operateedu.com.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • In no event shall OperateEDU, its officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of business opportunity, arising out of or related to your use of the Service.
  • Our total aggregate liability for any claims arising out of or related to the Service shall not exceed the total amount you paid to OperateEDU in the twelve (12) months immediately preceding the event giving rise to the claim.
  • Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, United States, without regard to its conflict of law principles.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Connecticut. Both parties consent to the personal jurisdiction of such courts.

11. Changes to Terms

We may update these Terms from time to time to reflect changes in our practices, the Service, or applicable law.

  • We will provide at least 30 days' notice of material changes via email to the account administrator on file.
  • The updated Terms will be posted on this page with a revised "Last updated" date.
  • Your continued use of the Service after the effective date of updated Terms constitutes acceptance of those changes.
  • If you do not agree to the updated Terms, you may cancel your subscription before the changes take effect.
